Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr., is seeking transfer to juvenile court after a Georgia grand jury indicted him on seven felony charges related to an alleged sexual assault, Page Six has exclusively learned.
Defense Files Motion for Juvenile Court Transfer
The teen’s legal team submitted a motion to “transfer to juvenile court and for confidentiality proceedings” on Tuesday, according to Fulton County Court records. The filing signals an effort to move the case from Superior Court into Georgia’s juvenile justice system, where KJ would no longer face prosecution as an adult and could receive less severe penalties if convicted.
Attorney Confirms Not Guilty Plea Strategy
KJ’s lawyer, Jason Sheffield, told Page Six on Tuesday that the defense expects to “enter a not guilty plea to all charges” at the arraignment hearing scheduled for Oct. 14. Sheffield confirmed the team planned to file the transfer motion so KJ could be “tried as a juvenile.”
“It is difficult to comprehend that a 14- or 15-year-old child can be held in detention for a month or longer simply waiting for a bond hearing,” Sheffield said in a statement to Page Six. “But that detention is a direct consequence of the detective’s decision to arrest him on charges of this magnitude.”
Grand Jury Indictment Details Seven Felony Counts
Last week, a Georgia grand jury indicted KJ on the following felony charges:
- Aggravated child molestation
- Aggravated sodomy
- Aggravated sexual battery
- Three counts of sexual battery against a child under 16
- False imprisonment
Arrest Stemmed from April Incident at School
Authorities arrested KJ on Aug. 19 in Alpharetta, Georgia, on charges of aggravated sodomy and aggravated sexual battery. The arrest followed allegations from a female classmate who accused him of assaulting her in a gym changing area on April 23.
According to court documents, the alleged victim told investigators that KJ forced himself on her after she said no while they were in a co-ed sauna. The documents state KJ allegedly made “multiple” attempts to have “sexual intercourse with her by trying to pull down her pants.” She also accused him of forcing oral sex and digitally penetrating her vagina.
The student said she managed to escape but did not report the alleged assault until the next day. She underwent a hospital examination on April 24. A police report states that no evidence of male DNA was found in her mouth or vagina during that examination.
Current Status and Upcoming Hearings
KJ remains held without bond at Atlanta’s Metro Regional Youth Detention Center. His bond hearing, initially scheduled for Tuesday but canceled, has been rescheduled for Sept. 11.
